2. Access and Use of Materials.

The Materials on the Site are limited to education, training, and advisory guidance for your own personal or internal company use and are intended to supplement, not replace, independent safety management, professional judgment, and compliance obligations of any individual or entity that accesses and/or uses Materials from the Site ("User"). Safety Navigator will not supervise, direct, command, or control the User's operations, staff, or third parties, and will not approve, certify, warrant, or assure compliance of the User's policies, procedures, or outcomes. Safety Navigator does not provide legal or regulatory advice.

 

Any Materials or statements by Safety Navigator are educational in nature and are not a substitute for independent professional advice by the User's counsel, clinicians, or other qualified professionals. The User is solely responsible for obtaining advice from qualified professionals, including legal counsel, as needed. The User remains solely responsible for its policies, procedures, training implementation, supervision, operations, and compliance with all applicable laws, regulations, codes, and standards.
 

3. Modification of Materials by Safety Navigator

Safety Navigator reserves the right to modify, suspend, or discontinue any Materials (in whole or in part) at any time, with or without notice. Any future release, update, or other addition to Site or its Materials will be subject to these Terms, which may be updated from time to time.
 

4. Donations

All donations are voluntary and processed securely through Wix Donations and its integrated payment providers. By submitting a donation, you agree to provide accurate information and authorize the specified payment amount.

Donations may not be refundable except as required by applicable law.
 

5. Privacy Policy

Safety Navigator will use reasonable care to protect your information provided on the Site, subject to legal disclosures and mandatory reporting. Nothing in these Terms prevents Safety Navigator from making disclosures required by law, including mandatory reporting of suspected child abuse, neglect, or imminent risk of serious harm, or from cooperating with law enforcement, child protection, licensing, or accrediting authorities.
 

6. Intellectual Property

This Site and all Materials, intellectual property, and content on this Site, including but not limited to visual interfaces, text, graphics, logos, icons, photographs, images, templates, tools, frameworks, documents, training content, guidance, data complications, code, software, copyrights, trademarks and other works provided or made available by Safety Navigator in connection with the Site, are and shall remain the sole and exclusive property of Safety Navigator or its licensors.

Subject to the User's compliance with these Terms, Safety Navigator grants the User a non-exclusive, non-transferable, non-sublicensable, revocable license to access, use, download, reproduce, distribute and modify the template documents and trainings owned by Safety Navigator and included in the Materials (collectively, the "Templates") solely for the User's own personal or internal company use. Nothing herein shall be deemed to transfer title to any Materials to you. Any modification or use of the Materials for any other purpose not contemplated herein is a violation of Safety Navigator's copyright and other proprietary rights, and Safety Navigator hereby reserves all rights not expressly granted in and to the Site and the Materials.
 

7. Use of Safety Navigator Name and Brand

The name "The Safety Navigator," together with Safety Navigator's trademarks, corporate name, trade name, service marks, designs, logos, symbols and all related branding ("Safety Navigator Marks"), are the exclusive property of Safety Navigator. The User may not use the Safety Navigator Marks in any manner without the prior written approval and permission of Safety Navigator, other than through the use of Materials as described above. Any permitted use must be accurate, non-misleading, and fully compliant with Safety Navigator's branding guidelines. Permission for use may be revoked at any time in Safety Navigator's sole discretion. Safety Navigator reserves the right to require immediate cessation of any unauthorized use.
 

8. Your Account

To use certain features of our Site, you may be required to create an account (an "Account"). You are solely responsible for the information associated with your Account and anything that happens related to your Account. You must maintain the security of your Account and immediately notify Safety Navigator if you discover or suspect that someone has accessed your Account without your permission at contact@thesafetynavigator.org.

Although Safety Navigator has no obligation to screen, edit, or monitor Your Content, Safety Navigator may, in our sole discretion, delete or remove Your Content, at any time and for any reason, including for violating these Terms.
 

10. Disclaimer

The Site and all Materials and Templates are provided on an "as is" and "as available" basis without representations, conditions, warranties or endorsements of any kind, either express or implied. For the avoidance of doubt, Safety Navigator makes no representations nor gives any warranties as to the currency, completeness, availability, accuracy or correctness of any of the elements contained herein, non-infringement of any intellectual property or its suitability for any purpose. While Safety Navigator has taken reasonable care in preparing and publishing the Materials contained on the Site, Safety Navigator expressly disclaims any liability with respect to the Materials, including the Templates, contained on this Site.
